Privacy Policy

This Privacy Policy describes how Agili8, Inc. ("Agili8", "we", "us", or "our") collects, uses, handles, and discloses your personal information when you visit our websites, use our software, or access our proprietary mobile and web applications, including the XRAI Vision® platform and custom software we build for our customers (collectively, the "Services").

 

We are committed to managing your personal information in an open and transparent manner in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy is also designed to comply with the developer privacy requirements of the Apple App Store and Google Play Store.

 

1. Collection of Personal Information (APP 3)

We only collect personal information that is reasonably necessary to provide, optimize, protect, and develop our Services. By using our Services, you consent to the collection of the following types of information:

  • Account and Profile Information: When you sign up for an account, we collect your name, email address, phone number, physical address and organisation you work for.

  • Service and Communications Data: Storage of data are disabled by default. When you utilize our applications, we store, process, and transmit your communications and metadata related to them only if you have subscribed to the relevant modules to do so. This includes storing call history, participants’ identity, call timestamps, connection quality, and session durations. If your organisation has subscribed to Evidence & Report modules, this may include still image snapshots, video recordings, and/or verbal data auto-scribed summaries.

  • External guests: You may choose to invite external guests such as your OEM manufacturer or customers to our mobile and web applications to facilitate sharing and remote collaboration. You are advised to only share information on a need-to-know basis and exercise professional judgement when you do so at your own risk.

  • Device and Technical Information: As required for mobile store transparency, we automatically collect data from and about the devices you use. This includes Internet Protocol (IP) addresses, browser type, device identifiers (such as unique device IDs), network performance, and operating system details.

  • Location Information: Depending on your device permissions, your mobile or web browser may transmit precise or general location information to ensure geographic-based app functionality and fraud prevention.

 

2. How We Collect Personal Information

We collect personal information through two primary pathways:

  1. Directly from You: Information you explicitly provide when registering an account, completing forms, setting up your organisation’s profile, or interacting with our technical support team.

  2. Automatically via App/Website Tracking: Technical markers, session activity logs, and system metrics recorded during your active use of the software. On our websites, we use tracking technologies such as cookies to manage user sessions and evaluate traffic trends.

3. Purpose of Use and Processing (APP 6)

Agili8 will only use or disclose your personal information for the primary purpose for which it was collected, or for related secondary purposes that you would reasonably expect. These purposes include:

 

  • Providing, operating, maintaining, and improving the operational capacity of the Agili8 software and XRAI Vision® platform.

  • Authenticating your account, managing subscriptions, and processing payment transactions.

  • Facilitating synchronization and internal communications between collaborators sharing the same organizational enterprise domain.

  • Fulfilling administrative and technical security updates, enforcing our End User License Agreement (EULA), and preventing fraudulent activities or system abuse.

4. Disclosure and Sharing of Information

We do not sell your personal data to advertisers or unrelated third parties. Your information is only shared under the following conditions:

 

  • Trusted Third-Party Service Providers: We engage ISO-27001 compliant vendors to perform core tasks on our behalf (such as cloud hosting, analytics, or payment gateways) under strict contractual privacy obligations.

  • Enterprise Administration: If you are an enterprise tier user, your corporate network administrator may hold the administrative rights to access, monitor, or restrict your profile data and usage logs.

  • Law Enforcement and Public Safety: We may disclose your information if reasonably required to comply with an applicable Australian law, regulation, valid legal process (such as a warrant or subpoena), or appropriate government request, or to protect individuals from serious bodily harm.

5. Overseas Data Transfers (APP 8)

To deliver our global remote services, personal information may be stored, processed, or transmitted across secure cloud environments located in the Australia and overseas for customers in the regions they operate. When transmitting data overseas, we take reasonable steps to ensure that the recipient handles your personal information in accordance with standards equivalent to the Australian Privacy Principles, often relying on formal Standard Contractual Clauses (SCCs) and data protection addendums. Our global vendors do not store your personal information unless you purchase cloud storage from us.

6. Data Security and Retention (APP 11)

We maintain comprehensive technical and organisational safeguards designed to protect personal information against unauthorized access, loss, misuse, modification, or disclosure. The access to personal data inside our database is restricted to minimal personnel bound by confidentiality agreements.

We retain your personal data only for as long as necessary to fulfill your active service requirements or as mandated for statutory record-keeping and corporate compliance.

7. User Controls: Consent Revocation and Account Deletion

In alignment with Apple and Google Play application developer guidelines, users retain explicit authority over their data lifecycle:

 

  • Revoking Consent: You can modify your system-level permissions (such as access to your camera, microphone, contacts, or location data) at any time through your iOS or Android device settings menu. Please note that revoking these settings may limit the functional features of our application.

  • Account Deletion: You can request the permanent erasure of your personal details and account records. To initiate a deletion process, you can navigate to your Account Settings page within the application or email your request directly to info@agili8.com. Deletion procedures are initiated securely; standard data flushing is processed after a 30-day latency period to accommodate backups and legal holds.

8. Access and Correction Rights (APPs 12 & 13)

You have a right under Australian law to request access to the personal information we hold about you, or to ask for corrections if you believe that information is inaccurate, out of date, or incomplete. We will respond to your access or correction request within 30 days without any fee. To make a request, contact our Data Protection Officer at info@agili8.com

9. Policy Changes

We may update this Privacy Policy periodically to reflect shifts in regulatory mandates or app store guidelines. The most recent iteration will always be accessible via our website and inside Apple Store or Google Play. If amendments materially impact your user privacy rights, we will provide prominent in-app notices or distribute direct email notifications.
